Advisory note as per article 13 of European Regulation 679/2016
In compliance with that set forth by EU Regulation no. 679 of 04.05.2016, known as the “General Data Protection Regulation”, we hereby provide you with the due information on the purposes for which and the methods with which your personal data is processed, the nature of the data in our possession and how this data is supplied.
THE PURPOSES FOR PROCESSING PERSONAL DATA
Data will be processed for the purposes connected with the contractual activities and, therefore:
- to implement a purchase order, to provide a service or to perform one or more operations, as contractually agreed;
- to contact the client in the case of a service anomaly and/or, in any event, for reasons regarding the service provided;
- to answer a client’s request;
- to implement operational or management needs;
- to contact a client to propose the renewal of a contract and/or contractual changes.
- To issue a client with a user code to access the company platform’s reserved area, where the user can access their personal details, download invoices and access all the information regarding the provision of the service.
The legal basis which makes this processing lawful is the fulfilment of pre-contractual and contractual obligations with the data subject.
In addition to the aforementioned purposes, processing will also be done:
- to fulfil obligations such as accounting and administrative ones;
- to fulfil other legal obligations.

THE METHODS USED TO PROCESS PERSONAL DATA
Processing will be carried out with both electronic and manual tools by parties specifically appointed to do so, in such a way as to ensure the greatest security and confidentiality of the data.
THE SCOPE OF COMMUNICATION AND DIFFUSION OF THE DATA
Your personal data, which is subject to being processed, will or may be subsequently communicated:
- to Processors, where appointed;
- to credit institutes and/or debt recovery firms (for the sole purpose of credit protection);
- to public bodies by way of fulfilling legal obligations;
- to supervisory bodies including the fire prevention service, INAIL, ASL Municipalities and Regions;
- to companies operating within the transportation sector such as shippers and couriers;
- any other communication or diffusion will only be done with your prior explicit consent.
The updated list of Processors (in terms of processing personal data) may be requested, via email, from the Controller.
Your personal data will not be communicated to a third country nor to an international organisation and will not be disseminated.
THE NATURE OF PROVIDING DATA
Providing data is mandatory since it is needed to fulfil contractual, accounting, tax and, more in general, administrative obligations.
The Controller also points out that failing to provide any mandatory data, or providing inaccurate data, will entail the following consequences:
- it will make it impossible for the Controller to guarantee that processing your personal data will be sufficient for the contractual agreements for which processing was done;
- it may make it impossible to execute the contractual relationship.
THE DURATION OF THE PROCESSING
The personal data provided by a data subject will be processed for the time strictly necessary to fulfil the existing contractual obligations and, therefore, for the entire duration of the contract. After this period, in respect of the principle of necessity, personal data will be processed and stored only for the period strictly necessary to fulfil legal obligations regarding tax and tax-related matters.
THE DATA SUBJECT’S RIGHTS
You have the right to exercise those rights afforded you by article 7 and articles 15-22 of EU Regulation 679/2016.
Specifically, by emailing the Controller at info@magigas.it, you may revoke, at any time, any consent previously granted; you may request access to the personal data that concerns you; you may request a copy of the personal data provided to the Controller and to have this data sent to another Controller without hindrance (so-called data portability); you may have the data updated; you may restrict processing of this data; and you may have the data rectified or erased when processed in violation of current regulations.
You also have the right, for legitimate reasons, to object to the processing of the personal data that concerns you and to processing this data for the purposes of sending you advertising materials, direct selling and taking part in market research. You also have the right to lodge a complaint with a Supervisory Authority, which in Italy is the Italian Data Protection Authority [“Garante della Privacy”].
